Roe vs. TeleTech

On June 9, 2011, the Washington Supreme Court ruled that TeleTech, a Colorado-based company, is within its rights for firing a woman after her drug-screen test tested positive for cannabis. But, that woman was an authorized medical marijuana holder.

Jane Roe, fired in 2006, sued and lost on an 8-1 vote. The court stated that even with a valid medical marijuana authorization and with no evidence that she was working while impaired, the company was still within its rights for firing her.

A case of employment discrimination against medical marijuana users practically getting thrown out in favor of a company, how could it happen? Well, according to the court, the laws weren’t clear enough.

Afterwards, Michael Subit, Roe’s attorney, pointed out that voters need to work on modifying the current medical marijuana law to protect employees’ right to use mmj outside of work.

The lone Justice that spoke out for the rights of medical cannabis patients argued that voters’ intent in passing the 1998 medical-marijuana law was to protect patients prescribed cannabis for medical purposes.

TeleTech’s director of marketing communications wrote this statement to The Colorado Independent: “...we are pleased with the Supreme Court of Washington’s ruling in the case of Jane Roe vs. TeleTech. The Court’s decision in TeleTech’s favor protects the rights of our U.S. employees to work in a safe and drug-free work environment.”

Safe? Let’s take a step aside and critically think about this. What if Jane Roe hadn’t been fired? What if TeleTech saw the drug result, validated her authorization, and since her use of medical marijuana did not interfere with her ability to work, let her keep her job. This does not change the work environment to be unsafe. I highly doubt Ms. Roe would have caused any trouble. In fact, she probably would have appreciated her new employer caring about her and her medical issues.

The director goes on to mention that maintaining a drug-free environment protects client’s customers’ confidential information. Mr. Director is taking generalizations about “drugs” and applying it to abstract consequences. This use of fear to try and convince people that TeleTech is the one in the right is disgusting.

Luckily, this attitude isn’t shared by many people around Washington State. This case has shown that not many people agree with TeleTech. There is a small minority that think it is alright to fire someone for using medical marijuana at home. That’s because it isn’t.

Since this case isn’t about Roe being impaired or using medical cannabis around work time, it is a case about Jane Roe’s status as a Medical Marijuana Patient. According to this decision, WA courts have made Jane Roe into an example that having the label of Medical Marijuana Patient means that you don’t deserve honest work.

But, wait... Let’s take a moment to see what other states have been thinking about the subject. Well, in Colorado, the home base for TeleTech, a Coors employee, Paul Curry, was fired for testing positive for medical marijuana. Unlike Roe, he won the unemployment case against Coors.
The statement from Curry’s attorney, Rob Corry, discussing the case in Washington, highlights some reasons why the case in Washington failed:

“My comment on the Washington case: The Roe case out of Washington is easily distinguishable from Mr. Curry’s action to be brought in Colorado, as Ms. Roe did not assert a claim for discrimination based upon disability, and that will be our chief claim in Mr. Curry’s case. Moreover, Colorado’s Constitution has stronger protections for medical marijuana patients than Washington statutes, and Colorado’s anti-discrimination laws are more solid precedent.”

Now, every Washington citizen that is a Medical Marijuana patient has to fear for their employment status. They have to worry that the label of ‘medical marijuana’, despite its legality, might get them fired. Companies need no other reason. A employee could be doing the best they can and be ready to work hard, but that drug-screening test will automatically shut down their opportunities. The worst part about it is that patients with medical marijuana often have it because it gives them a quality of life where they are actually able to go work.

In my opinion, this whole court ruling is based off of ignorance and fear. The Justices chose the safe way and threw the mess onto “the voters”. The voter process requires a mass amount of energy, time and resources. By the time this whole issue is sorted out, thousands of people could be fired out of discrimination for medical marijuana patients.

Using Cannabis Oil at Night to Feel Good in the Morning.

Got muscle pain? Back pain? Nerve pain? Well, here's a handy tip I found out about.

1. Take a nice warm bath with some essential oils (I use rosemary/lavender). Relax.

2. When you get out of the bath, dry off and head towards bed.

3. Make sure you have MMJ oil, spray or lotion.
I used the spray kind but I've had lotion and that works as good.

4. Rub the oil/lotion over your whole body, making sure to rub it in on the spots that are the most painful.

5. Get in bed, rub the oil/lotion on the bottom of your feet.

6. Go to sleep.
Read a book if you can't fall asleep right away.

There is a strong chance you will wake up feeling refreshed and 110%!

That I was able to wake up feeling good was a very pleasant surprise. Usually, I have to vape in the morning because of nausea or headaches, but today I didn't have to do anything!

I hope this helps some of you out!

Blessed Be.

[Strain Review]

Strain: Violator Kush
["Indica" (Could be an Indica-dominant Hybrid* )]

Dispensary: Captiol Hill Patient Group

Donation: $15/gram.

Smell: A pine-like, light, herb-garden smell. It reminded me of rosemary or lavender.

Looks: Dry, darker green with midtone orange hairs and a fine layer of crystals/trichomes.

Taste: The taste wasn't overpowering and actually quite smooth/light. There was an aftertaste of weed, which wasn't necessarily a bad thing.

Method of Ingestion: Vapor Balloon, followed with a Joint.

Toker's Tolerance: Med-High. Daily Vapor-user.

Buzz Type: A strong body high that relieved any muscle tension I had at the time. I was able to function at about 40% productivity (compared to a sober 80%), but found spelling and writing harder than normal. But, I was able to focus on reading and felt ambitious, it aided with an excellent high for researching/surfing the web.

About an hour and a half later, I was suddenly sober. The comedown either didn't exist or was unnoticable as I ended up being, 'Hey. Where'd my high go?'. All of the pain relief that had come with the high, disappeared. It was fairly disappointing.

So, I rolled up and smoked a quick J. After this, the relief returned and the Kush effect kicked in. Life slowed down. I got tired. After working on some artwork, I ended up laying in bed and playing online games. I could have passed out if wanted, but didn't have to.

Buzz Length: 1.5 - 2 hours top.

Overall: I would classify the buzz as a hybrid with a strong, but very short body high. The sudden nature of the comedown was off-putting. The suggested donation price is too much for this strain. It is not worth 15$/gram, I would be more comfortable donating like 10$/gram as a fair price. The reason why the price is higher is due to the fact that it is a "local favorite".

Suggested For: This is a good strain if you have somewhere to be in 4-5 hours and want to relax your muscles, do research or surf the web before you head out. If you smoke enough of it, it'd be good for a nap.

*  When I was looking for pictures of this strain online, I found there has been discussion on whether this strain is truly an indica or just a hybrid-kush. This question comes with good reason, while there are kush-like qualities after smoking enough, the short timeline and the ability to be productive makes it questionable. There was no couchlock at all. I even went to the market down the street because I wanted some orange soda. Now, if I was smoking a pure, heavy indica, I'd be drinking water and pretending it was orange soda because I'm too relaxed to get dressed and go out in the rain for a soda. I was told by the CHPG it was Indica, but when I went back and asked again they admitted they didn't really know for sure.

Stoned in Class

Over my years as a student and a marijuana partaker, there have been incidents where I have gone to class stoned, baked-over, or high. Now, I always just relax and do whatever I normally would do. I assume it's no big deal.

Apparently, not everyone thinks this way! I found out that some think that you should actually pay attention to the class and do nothing else. This is an extremely unrealistic perspective. For the people like me that know better, this is my...

STONED IN CLASS: THINGS TO DO!!!!

1. Doodle!
Doodle all over your notes and text!

2. Look around at the other students and guess what they do in their freetime, why they chose to wear what they did, etc.
Never forget, people-watching IS fun!

3. Try to guess who are the other stoners in the class.

4. Doodle the people you're watching!
And always accentuate the biggest part  of their body (lips, butt, boobs, etc.).

5. Pay attention ONLY when needed; Lots of lectures and classes really don't require 100% attention, more like...
- 20%; enough to hear,
- 7 %jot down notes,
- 15% be able to apply it to a 1 page paper
Though in classes of 15-20 students, there is an extra 15% to account for the teacher being able to see the whites of your eyes. But these classes are small because they do require attention.
It is an inverse correlation. The more students in a class, the less attention required in lecture.

5 [Productive] Things To Do while High, Stoned or Baked

One of the most common questions of the new stoner is 'What Do Ya Do High?' 'What Should I do when baked?'. Well, here are five things that you can do right now with minimal prep! Bonus: And they're productive!

Number ONE. 1. Do Yoga! Stretch towards the earth. Reach over to water. Stretch towards the sky. And bring it central to your inner fire... or something like that. But, Mix some Grand Daddy Purple, some Pure Moods beatz, and do your favorite yoga poses.

Number TWO. 2. Read a Book! If you're too lethargic to do Yoga, then crash on the couch and open a book. Flip through until something catches your interest. Whether it be fantasy, mystery, or non-fiction, it's "better" for you than watching tv, but more lazy than doing almost anything else.

Number THREE. 3. Write a Story. If you're feeling creative, there are lots to do but nothing is quite as accomplishing as writing up a story. I love to place a vintage ashtray with a joint next to me and my laptop while I write. I also keep a legal pad to jot down ideas. Sometimes though, I prefer the classic style of writing directly on legal pad with a pen. On writing stories, you can make it whatever you want in whatever style. This is for your eyes only (unless you wanna share it)... but this is mainly an exercise in exploring your imagination and subconscious.

Number FOUR. 4. Drink Water! Nothing is more productive for your body than drinking water. It's amazing how many people forget this simple task. For something you gotta do, it's delicious and you'll feel awesome for doing it later!

Number FIVE. 5.  Relaaaaax. The best productive thing to do while stoned is to relax. Let go of all that stress and tension everyday life causes in us. Close your eyes, sit back, chill to some music or the silence. Enjoy doing Nothing.

And that's five productive things to do while High, Stoned, or Baked.
Peace.
